These Terms of Service govern your access to and use of Suuqa (the "Site", "we", "us"), operated at suuqa.shop. By creating an account or placing an order on the Site, you agree to these Terms.
1. What Suuqa is. Suuqa is an online marketplace. We provide the technology that lets independent sellers ("Vendors") list products for sale on the Site. Unless a product is listed as sold directly by Suuqa, the Vendor is the seller of record for that product.
This matters for your rights: your contract to buy a product is with the Vendor, not with Suuqa. Our Returns Policy and Shipping Policy are administered by us on the Vendor's behalf so that you have a single point of contact.
2. Eligibility and accounts. You must be at least [18] years old to open an account and place an order. You agree to provide accurate, current information and to keep it updated — in particular your name, email address, phone number and delivery address.
You are responsible for activity on your account and for keeping your password confidential. If you believe your account has been used without your permission, notify us immediately at

3. Orders and acceptance. An order placed on the Site is an offer to buy. A contract of sale is formed only when we — or the Vendor on whose behalf we act — send you an order confirmation. We may decline or cancel any order before confirmation, for example where:
the product is out of stock or its listing was in error;
we cannot verify your payment, or the payment is reversed;
the delivery address is outside our delivery areas or is incomplete;
the order appears to be placed by a dealer or for resale without our agreement.
If we cancel after payment, we refund the full amount to your original payment method [no cancellation fee applies to customer-side cancellation].
4. Prices and payment. All prices are shown and charged in United States Dollars (USD). Prices include any applicable taxes and duties unless stated otherwise at checkout.
We accept payment by mobile money through Sifalo Pay and Sifalo e-Wallet. Full payment is due at checkout; we do not extend credit. We confirm an order only once payment has cleared. If a payment is not completed within 30 minutes / 24 hours, the order may be cancelled and the reserved stock released.
Where a price is listed in error and is obviously incorrect, we may cancel the order and refund you in full rather than supply at the incorrect price.
5. Your obligations when buying.You must be 18 or older to buy any age-restricted product, where such a product is listed [confirm whether any age-restricted categories are sold].
You must not buy for resale without a written agreement with us.
You must provide accurate delivery details. Incorrect or incomplete addresses are the most common cause of failed delivery and are not grounds for a refund — see the Shipping Policy.
6. Acceptable use. You may not use the Site to: post unlawful or defamatory content; infringe anyone's intellectual property; attempt to gain unauthorised access to the Site or another user's account; scrape or harvest data; place fraudulent orders; or circumvent any security or pricing control.
7. Intellectual property. The Site's design, code, branding and content are owned by us. Product listings, images and descriptions supplied by a Vendor remain that Vendor's property. You may not reproduce the Site or its content commercially without our written permission.
8. Liability. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence or for fraud.
Subject to that, we are not liable for indirect or consequential loss (including loss of profit, income or opportunity). Where we are liable, our total liability is limited to the amount you paid for the relevant order.
Nothing here limits the Vendor's liability to you for a defective product; that liability sits with the Vendor.
9. Complaints and dispute resolution. Raise complaints with us first at
[email protected] and we will aim to respond within 3 business days.
10. Changes and governing law. We may update these Terms; the "last updated" date above always reflects the current version.
These Terms are governed by the laws of Republic of Somalia.
